Terms of Service

Introduction

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Vandelay Softworks Inc. ("Vandelay," "we," "us," or "our"), the parent company and maintainer of the Down Bii platform ("Down Bii" or the "Service").

By accessing, installing, interacting with, or otherwise using Down Bii, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately cease all use of the Service.

Description of Service

Down Bii is a Discord-integrated software bot that enables users to interact with and obtain information related to the Super Smash Bros. Ultimate game franchise. Down Bii allows users to fetch data, organize tournaments, participate in competitive "League Mode," and access other social or competitive integrations between Discord and Super Smash Bros. Ultimate.

The Service is owned and operated by Vandelay Softworks Inc., headquartered in Vancouver, British Columbia, Canada.

Eligibility

Use of Down Bii is restricted to individuals who meet the following minimum age requirements:

• Global Users: Must be at least thirteen (13) years of age.
• European Union and EEA Residents: Must be at least sixteen (16) years of age, in compliance with Article 8 of the General Data Protection Regulation (GDPR).

By using the Service, you represent and warrant that you meet the applicable age requirement and have the full legal capacity to enter into these Terms.

Account Creation and Responsibility

Certain features of the Service may require you to create or link a user account. You agree to provide accurate, current, and complete information when establishing your account and to maintain such information as necessary.

You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. Vandelay shall not be liable for any loss or damage arising from unauthorized use of your account.

Termination of Access

Vandelay Softworks Inc. reserves the absolute and unconditional right to terminate, suspend, or restrict access to any user account or the Service, in whole or in part, for any reason or no reason at all, at its sole discretion and without prior notice or liability.

This includes, without limitation, termination for violation of these Terms, suspected misuse, malicious conduct, or at Vandelay’s business discretion.

Paid Features and Payments

Certain optional features or benefits of the Service may be accessible through financial contributions or subscriptions processed by Patreon Inc.

Payments are handled exclusively through third-party payment processors, including Stripe, PayPal, Payoneer, Apple Pay, and Google Pay, as applicable. Vandelay Softworks Inc. does not directly process or store payment information.
